Data Processing Agreement (DPA)

Date: 28th March 2026

This Data Processing Agreement (“Agreement”) is entered into between the parties under and subject to the Terms & Conditions of the relevant platform where it is incorporated (including BookYourWebinar) and applies whenever the Processor processes Personal Data on behalf of the Controller.

  1. Definitions

For the purposes of this Agreement:

  • Personal Data: Any information relating to an identified or identifiable natural person.
  • Processing: Any operation or set of operations performed on Personal Data (e.g., collection, storage, consultation, transmission).
  • Controller: The legal entity that determines the purposes and means of processing Personal Data.
  • Processor: The legal entity that processes Personal Data on behalf of the Controller.
  • Sub-processor: Any third party appointed by the Processor to process Personal Data on behalf of the Controller.

These definitions are consistent with GDPR and UK GDPR.

  1. Subject Matter

This Agreement governs the Processing of Personal Data by the Processor on behalf of the Controller in connection with the Controller’s use of the Processor’s services via BookYourWebinar (the “Services”).

  1. Duration

Processing shall continue for the duration of the Controller’s use of the Services and shall automatically terminate upon termination of the relevant Terms & Conditions, unless otherwise required by law.

  1. Obligations of the Processor
  1. Instructions: Processor shall only Process Personal Data on documented instructions from the Controller. If Processor believes any instruction violates applicable law, it shall promptly inform the Controller.
  2. Confidentiality: Processor ensures that personnel with access to Personal Data are bound by confidentiality obligations.
  3. Security: Processor shall implement appropriate technical and organisational measures, including but not limited to:
    • Encryption of Personal Data in transit
    • Access control and authentication
    • Regular backups and disaster recovery procedures
    • Monitoring, logging and intrusion detection
    • Security incident response procedures

  4. Sub-processing:
    • Processor may only engage Sub-processors with general written authorisation from the Controller.
    • Controller will be notified of any material changes to Sub-processors and may object in writing within 10 business days. If no objection is received, consent is deemed given.
    • Sub-processors must be bound by obligations at least equivalent to this Agreement, and Processor remains fully responsible for their acts and omissions.
  5. Data Subject Rights: Processor shall assist Controller in responding to requests from data subjects exercising their rights under applicable law.
  6. Breach Notification: Processor shall notify Controller without undue delay upon becoming aware of any Personal Data Breach affecting Controller’s data.
  7. Audit and Compliance: Processor shall provide information and cooperate with audits, inspections, or independent assessments, as reasonably requested by Controller, to demonstrate compliance with this Agreement and applicable law. Reasonable notice shall be provided, and audit frequency shall not be excessive.
  1. Obligations of the Controller

Controller warrants that:

  • It has a lawful basis to provide Personal Data to Processor.
  • Instructions comply with applicable data protection laws.
  1. International Transfers

Personal Data may be transferred outside the UK/EEA to sub-processors, including the United States, only under appropriate safeguards such as the UK International Data Transfer Agreement, EU Standard Contractual Clauses, or other GDPR/UK GDPR-compliant mechanisms to ensure an adequate level of protection. Copies of the relevant transfer agreements will be provided to the Controller upon request.

  1. Data Return or Deletion

Upon termination of Services, Processor shall, at Controller’s option:

  • Return all Personal Data securely, or
  • Permanently delete all Personal Data, except where retention is required by law (e.g., tax, accounting, or legal obligations).
  1. Liability

Liability related to Processing under this DPA is governed by the underlying Terms & Conditions, except to the extent prohibited by applicable data protection law. Nothing in this DPA excludes the Processor’s liability for breaches of its obligations under GDPR/UK GDPR or for intentional or negligent acts causing Personal Data loss or unauthorized access.

  1. Governing Law

This Agreement is governed by the laws specified in the Terms & Conditions (e.g., England & Wales).

  1. Incorporation

By accepting the Terms & Conditions, the user also accepts this DPA, which is incorporated by reference and forms part of the Terms & Conditions.

Welcome to the Course Builder

The Course Builder is an intuitive tool designed to help you create attractive and useful online courses and webinars for your students from start to finish. Follow the steps below to build your first course.

1. Starting Your Course

To begin, simply navigate to your personal profile page on the platform and click the Add New Course button. This will open up the main builder environment where you can manage all your content.

2. Course Information

Once inside the builder, you will need to provide essential details. This information gives potential students a clear understanding of your content and helps them make an informed decision to enroll.

  • Title & URL: Give your course a clear, engaging name.
  • Category & Level: Categorize your course appropriately and assign a difficulty level (e.g., Beginner, Intermediate).
  • Cover Image: Upload a high-quality cover photo to make your course visually appealing in the directory.

After filling out the main information, click the Create button to unlock the curriculum and settings tabs.

3. Building the Curriculum

A successful course is divided into logical sections. This structures the content clearly, making it easier for learners to navigate and understand the flow of the topics.

  • Add Sections: Group your content into broad modules or weeks.
  • Add Lessons & Assessments: Under each section, add specific video lessons, text documents, interactive polls, or quizzes.
  • Search Materials: Use the "Search materials" button to quickly locate and incorporate previously created lessons or quizzes without having to rebuild them from scratch.

4. Course Settings & Access Control

Navigate to the Settings tab to manage how and when students interact with your content.

  • Access Time Limit: Set an expiration date (e.g., course expires 30 days after enrollment). Students will be notified as the expiration date approaches.
  • Prerequisites: Require students to complete another one of your courses before they are allowed to enroll in this one.
  • Course Files: Attach downloadable materials (PDFs, Worksheets, Slide decks) that students can access alongside the course video.

Reward your students and customize the look of your landing page.

  • Certificates: Choose from a selection of pre-made certificates. When a student completes 100% of the curriculum, they will automatically be issued this certificate.
  • Course Page Style: Override the platform's default layout for this specific course. Choose between Classic, Modern, Minimalistic, or Bold layouts to best suit your content.

6. Pricing Your Course

The Pricing section lets you define how learners will access your content. You can set your course to be completely free to build an audience, or charge a fee to monetize your expertise.

  • Free: Anyone registered on the platform can enroll instantly.
  • One-Time Purchase: Charge a flat fee for lifetime (or time-limited) access. You can also configure a temporary Sale Price with start and end dates.
  • Subscriptions: Charge a recurring monthly or annual fee for access to the course.
  • Group Pricing: Offer discounted bundle pricing for enterprise or group enrollments.

  • FAQs: Add a list of Frequently Asked Questions to the course landing page to preemptively address common doubts and reduce support queries.
  • Notices: Use the Announcements feature to communicate important course-related updates, schedule changes, or welcome messages to enrolled students.

If any courses remain active or published after cancellation, your account may continue to be billed at the standard rate of £50 per month, and any paid course earnings will be allocated to Book Your Webinar.
